Emergency is Emergency:
You can call 911 from a cell phone without plan
You can call 911 from a cell phone with no service
You can call 911 from a brand new cellphone that is not even activated
You can call 911 from an old cell phone that is outdated


Operational Requirements:
1. Phone must have a working charged battery
2. Phone must have a signal from a nearby cellular tower


Legality:

Cellular Networks/Carriers are mandated (required by law) to receive and route emergency 911 calls.
